Given that brockton bay's residential state is unspecified the legality of the casino is hard to pin down. Regardless being outside the cuty limits allows the casino to take advantage of the city as a revenue source while not paying taxes to the city.

Given the redevelopment of Brockton Bay the casino was persumably in the black again. Which is all it cared about really.
